Terms & Conditions

1. Definitions

• "stillponenyn" / "We" / "Us" — refers to stillponenyn, the service provider, operating from No. 99, Section 2, Renai Road, Neihu District, Taipei 114, Taiwan.
• "Client" / "You" — refers to the individual or family entering into a service arrangement with stillponenyn.
• "Service" — refers to the in-home elderly care and assistance services described at stillponenyn.club.
• "Elder" — refers to the individual in the household for whom care is arranged.
• "Agreement" — refers to these Terms & Conditions together with any written service agreement signed by the parties.

2. Acceptance of Terms

By submitting an enquiry, entering into a service agreement, or using our website, you confirm that you have read and accepted these Terms & Conditions. You must be at least 18 years of age and have legal capacity to enter into a binding agreement on behalf of yourself and the elder for whom care is being arranged.

3. Service Description

stillponenyn provides in-home assistance and companionship services for elderly adults in Taipei, Taiwan. The services offered are:

• Daytime Companionship — scheduled in-home presence during waking hours
• Errand & Outing Assistance — accompanied outings and transport logistics
• Round-the-Clock Home Support — continuous coverage through day and night

stillponenyn is not a registered medical or nursing service. Our helpers do not provide clinical or medical care, and services should not be considered a substitute for professional healthcare.

4. Service Arrangements

Each arrangement begins with a consultation and is documented in a written service agreement. The scope, schedule, and pricing are confirmed in writing before services commence. Arrangements may be adjusted by mutual agreement. Changes take effect from the date confirmed in writing by both parties.

5. Client Responsibilities

• Provide accurate and complete information about the elder's needs and household conditions
• Notify stillponenyn promptly of any change in the elder's health, mobility, or circumstances that may affect the arrangement
• Treat stillponenyn helpers with respect and ensure a safe working environment in the home
• Not request helpers to perform tasks outside the agreed scope of service
• Not attempt to engage stillponenyn helpers for private arrangements outside of the stillponenyn arrangement for a period of 12 months following the conclusion of services

6. Prohibited Activities

• Requesting helpers to perform tasks that pose safety risks
• Sharing helper contact details with third parties without stillponenyn's written consent
• Using our website in a way that is harmful, unlawful, or disruptive
• Providing false information during enquiries or in the course of a service arrangement

7. Intellectual Property

All content on our website — including text, design, images, and structure — is the property of stillponenyn or its licensed content providers. You may not reproduce, distribute, or use this content without written permission. You are granted a limited, non-exclusive right to access and view the site for personal, non-commercial purposes.

8. Payment Terms

Pricing for each service type is confirmed in writing prior to commencement. Invoices are issued monthly and are payable by bank transfer within 14 days of issue. Currency is New Taiwan Dollar (NTD). There are no enrolment fees. Late payments may result in suspension of services after written notice.

Adjustments: If the scope of service changes, pricing adjustments will be confirmed in writing and reflected in the following invoice period.

9. Service Adjustments and Termination

Either party may end the arrangement with 14 days' written notice. stillponenyn reserves the right to terminate an arrangement immediately if the safety or wellbeing of a helper is at risk, or if the client materially breaches these terms. Fees are payable for services delivered prior to termination.

10. Disclaimers

stillponenyn provides its services with care and professionalism. However, we make no specific guarantees regarding outcomes. Our helpers are not medical professionals, and nothing in our service constitutes medical advice, clinical supervision, or a healthcare intervention. Families should consult qualified medical practitioners for health-related matters concerning the elder.

11. Limitation of Liability

To the extent permitted by Taiwan law, stillponenyn's liability for any claim arising from these terms or from the provision of services is limited to the fees paid by the client in the 30 days preceding the event giving rise to the claim. stillponenyn is not liable for indirect, consequential, or incidental damages.

12. Indemnification

You agree to indemnify and hold harmless stillponenyn, its coordinators, and helpers from claims, losses, or costs arising from your breach of these terms, from inaccurate information provided to us, or from misuse of our services.

13. Dispute Resolution

These terms are governed by the laws of Taiwan (Republic of China). In the event of a dispute, both parties agree to first attempt informal resolution by written communication. If unresolved within 30 days, disputes may be referred to the courts of Taiwan, with Taipei District Court as the agreed venue of first instance.

14. General Provisions

• Entire Agreement: These terms, together with any written service agreement, form the complete agreement between the parties.
• Severability: If any provision is found unenforceable, the remaining provisions continue in force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights under this agreement without written consent. stillponenyn may assign operational functions to team members in the normal course of business.

15. Changes to These Terms

We may revise these terms from time to time. Updated versions will be published on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the revised terms. For significant changes affecting ongoing arrangements, we will provide notice directly to affected clients.
